TERMS AND CONDITIONS
- 1.By entering
this competition you accept and are bound by the terms and conditions set out
below.
- 2.The
competition is not open to employees of Media 24 or their immediate famlies.
- 3.Winners
must have a valid driver’s licence.
- 4.Initial
registration of the vehicle will be paid for by Media 24.
- 5.Winners
undertake to collect vehicles from their nearest South African Motorcycles:
Jonway dealership.
- 6.If
you are a winner you are responsible for your own insurance on the scooter.
- 7.The scooter
used in any advertising material, is only a representation of the prize and there
are no guarantees made regarding the colour or model of the scooter.
- 8.The competition starts on 8 March 2015 at 00:00 and ends on 27 March 2015 at 23:00.
- 9.The winners for readers that entered via [email protected] will be determined by the Daily Sun editor in Chief. This will takes place Tuesday 12:00 noon on 31 March 2015. The editor of Daily Sun will select the top two best selfies. These two selfies will each win a Jonway Gomoto Sunny scooter and a helmet.

- 11.Any entries, for whatever reason, received after 23:00 on 27 March 2015 will not be accepted.
- 12.There
are two different ways to enter.
- 12.1 You can enter to win one of two Jonway Sunny Scooters by sending a picture of yourself to [email protected].
- 12.2 The second way to win a third Jonway Sunny Scooter is by sending a picture of yourself to [email protected].
- 13.It is
your responsibility to ensure that any information that you supply to us is accurate,
complete and up to date.
- 14.Any
costs or expenses that you may incur are for your own account, save for those items
that are specifically included in a prize. Media24 or its affiliates will not
be responsible for any costs or expenses that you or your companion (if
applicable) incur during and for the purpose of you entering the competition and
you accepting and/or utilising the prize.
- 15.We do
not make or claim or offer any guarantees, explicitly or implicitly, regarding
a prize, and in general, but without exception, we do not claim or give no
guarantee that:
- 15.1.you entering or participating in the competition
will necessarily result in you winning a prize;
- 15.2.a prize or any aspect thereof will be
satisfactory, timeous, without defects, safe or reliable.
- 16.We
and our affiliates will not be responsible for any injury, damage, loss or claim
related to the provision of any element of a prize or any changes to a prize
which may be made at any time.
- 17.Prizes
are not transferable and may not be postponed, changed or exchanged for cash or
exchanged for any other item.
- 18.The
prize will only be handed over to the person in whose name the entry is and the
vehicle will be registered in that person’s name.
- 19.The
names of the winners will be published
after the 26th of March 2015 in Media24 newspapers that are part of this
promotion.
- 20.The
winners will be notified according to the contact information supplied to us.
If we or a third party supplier are unable to contact the winner by telephone
within 2 weeks or if the winner cannot claim the prize within 60 days, the
winner will forfeit the prize and Media24 and its affiliateswill reserve the right to draw a new
winner under the same conditions.
- 21.By
entering this competition you concent that Media24 and its affiliates may use
your personal information and or pictures that you sent as part of the entry,
as well as your picture and personal information should you be a winner, in
promotional purposes and for publication in Media24 newspapers that are part of
this promotion and the Media24 digital platforms.
- 22.Winners
must supply us with personal information (ID number, full address and contact
numbers) to claim the prize.
- 23.In the
event where you win a prize that is supplied by a third party supplier, the
supplier will contact you to arrange for collection of the prize. (In this
regard you have to receive the prize at the time and on the date agreed with
the supplier. All correspondence regarding the prize must be addressed to
the supplier of the prize.
- 24.We
and our third party suppliers, as the case may be, reserve the right to change,
postpone, suspend or to cancel the competition and any prizes or any aspect
thereof, without any notice, at any time, for any reason that we may deem
necessary. In the event of such a change, postponement, suspension or
cancellation, you agree to waive any rights, interests and expectations that
you have with regards to this competition and you acknowledge that you have no
right to damages against us, our affilliates and third party suppliers.
- 25.We
and our affiliates will not be responsible and do not accept any responsibility
for any loss, obligation, injury, costs or damage (whether directly, indirectly,
accidentally, punitively or consequentially) of any nature that is suffered due
to negligence or any other cause resulting from you participating in the competition
or the accepting of any prize and/or utilising any prize by you or your
companion (if applicable) or due to any action taken by us or our affiliates in
terms of the terms and conditions.
- 26.If
you or your companion (if applicable) fail to adhere to any of these terms and
conditions, you will, save for any other legal remedies at our disposal:
- 26.1.automatically be disqualified and you will
forfeit the prize(s) (in which event you have already won a prize);
- 26.2.pay us for any loss or damage that we
suffered directly or indirectly due to your (or, if applicable, your companion’s)
non-compliance, including all our legal costs (including attorney- and own
client costs) that we may incur to take steps in terms of your (or your
companion’s) non-compliance; and
- 26.3.you will indemnify us and our affiliates
of any claim by any person (whether directly, indirectly, accidental, punitive or
consequential) of any nature, due to negligence or any other cause, that relates
to death, injury, loss and/or damage that may be suffered due to your (or your
companion’s, if applicable) failure to comply with these.
- 27.Personal information gained from you, will in terms of best business practice in the Republic of South Africa
be stored and processed.
- 28.By
participating in our promotions your personal information (cellphone number) is
automatically stored in a data base for future promotion purposes. You
therefore agree that Media24 and its affiliates may contact you in the future
for promotions.
- 29.Personal
information will not be traded, sold or leased to third parties. Although we
endeavour not to make your personal information public to third parties, unless
we have your consent, or for the purpose of our legal business interests, we do
not guarantee that your personal information will not be shared with third
parties without your consent.
- 30.These
terms and conditions will be explained, interpreted and applied according to
contract laws and dispute resolution laws in the Republic of South Africa.
- 31.Media24
and its affiliates and the
adjudicator’s decision about any case concerning the competition and/or any case
that may result from these terms and conditions, is final and binding on you
and no correspondence will be entered into about this.
