THE Nelspruit Commercial Court will rule on whether to remove the multi-million-rand corruption case against former State Security Minister Bongani Bongo and 16 others from the court's roll.
Bongo and his co-accused made a 174 application in 2023 for some of the charges to be withdrawn against them.
They claim there's no evidence linking them to the sales of two farms.
State Advocate Henry Nxumalo argued that the accused acted for a common purpose.
He told the court that there is prima facie evidence in the form of bank statements and affidavits from the office of the deeds in Mpumalanga. Nxumalo said all the documents were handed in court with no objection.
Meanwhile, the defence submitted to the court that everything was done following the law.

The accused are facing charges of corruption, fraud and money laundering. The charges emanate from dodgy land deals amounting to R74 million.
The crimes allegedly were committed between 2010 and 2011 while Bongo was still an employee at the Mpumalanga Department of Human Settlements.
The allegations are in connection with the sale and purchase of a farm in Naauwpoort, Emalahleni, by the Department of Human Settlement on behalf of Emalahleni Local Municipality.
It's alleged that some of the accused, acting with consent and with a common purpose, exploited the normal purchase of land for the government by misrepresenting facts to the Department of Human Settlement regarding ownership and the true sale price of the farm.
The judgment was supposed to be delivered last month.
However, magistrate Deon Van Rooyen said he was not ready and asked to postpone the matter to Thursday, 2 May.
